By signing up to receive SMS messages from creators through Last Drop, you agree to these Terms of Service. Please read them carefully.
1. Acceptance of Terms
By signing up for Last Drop, you agree to be bound by these terms and any future amendments and additions to these terms as published through our service. If you do not agree to these terms, please do not use Last Drop.
2. Description of Service
Last Drop provides a platform for content creators to send promotional and informational text messages to their subscribers. These messages may include updates, announcements, or other content related to the creator's activities, within the bounds of appropriate and lawful communication.
Allowed Content
- Promotional Content: Updates about new products, services, or upcoming events.
- Informational Content: Educational materials, tips, or news related to the creator's field of expertise.
- Engagement Content: Polls, questions, or interactive messages designed to engage the subscriber base.
Prohibited ContentTo ensure a safe and legal environment for both creators and subscribers, the following types of content are strictly prohibited on Last Drop:
- Illegal Activities: Content promoting illegal activities, or that facilitates the promotion of such activities.
- Offensive Material: Messages containing hate speech, threats, or discrimination against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or any other characteristic.
- Harmful Content: Messages that are defamatory, violate another person's privacy, or are otherwise malicious.
- Misleading or Deceptive Content: Messages that are intentionally deceptive or misleading, including false advertising and scams.
Last Drop reserves the right to remove any content that violates these guidelines and to suspend or terminate accounts involved in such violations. By using our service, content creators agree to adhere to these content standards and ensure that their messages remain appropriate and lawful.
3. User Registration
To receive SMS messages through Last Drop, you must provide a valid phone number and any other information required during the registration process. To register, you must be 18 years of age or older. Minors under the age of 18 are not permitted to use the service. By providing your information and registering, you confirm that you meet the age requirement and consent to receive messages from Last Drop at the phone number you provided for such purposes.
4. Privacy
Your privacy is important to us. Our Privacy Policy here explains how we collect, use, and protect your personal information. By using Last Drop, you agree to our collection, use, and sharing of your data in accordance with our Privacy Policy.
5. Fees and Payments
Last Drop is free for subscribers. However, standard message and data rates may apply to each text message sent or received as detailed in your mobile phone service agreement.
6. Message Frequency
The frequency of messages may vary depending on the content creator’s schedule and activities.
7. Opt-Out Policy
You can opt out of receiving SMS messages from Last Drop at any time by texting STOP. Opting out may prevent you from receiving all messages from the creators you subscribe to.
8. Limitations of Liability
Last Drop will not be liable for any delays or failures in the receipt of any mobile messages as delivery is subject to effective transmission from your network operator. Furthermore, Last Drop is not liable for any losses or damages arising from the use of the service, the inability to use the service, or unauthorized access to or alteration of your transmissions or data.
9. Indemnification
You agree to indemnify, defend, and hold harmless Last Drop, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these terms or any activity related to your account (including negligent or wrongful conduct).
10. Modifications to Service
Last Drop reserves the right at any time to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice. You agree that Last Drop shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the service.
11. General Conditions
We reserve the right to refuse service to anyone for any reason at any time. This includes, but is not limited to, the right to suspend or terminate your account if we determine that you have violated any part of these terms of service, engaged in fraudulent activities, violated content rules, or have been involved in spamming or other disruptive behavior.
Conditions for Account Suspension or Termination:
- Violation of Terms: Any breach of the terms set out in this agreement, including the misuse of the service or the violation of our content rules.
- Fraudulent Activity: Engaging in fraudulent activities, such as using stolen or fake identities, is strictly prohibited and will result in immediate account termination.
- Spamming: Sending unsolicited messages or conducting any form of harassment through our platform.
- Harmful Behavior: Actions that threaten the safety or security of another person, including threats of violence or abusive language.
Upon suspension or termination, you will be notified using the contact information provided at registration. You may appeal the suspension or termination by contacting us at support@lastdrop.com. We are committed to maintaining a fair and safe platform for all users and will review each case thoroughly before making a final decision.These terms of service constitute the entire agreement between you and Last Drop and govern your use of the service, superseding any prior agreements between you and Last Drop (including, but not limited to, any prior versions of the terms of service).
12. Governing Law
These terms and the relationship between you and Last Drop shall be governed by the laws of the state without regard to its conflict of law provisions.
